Gee, I dunno. As we know from the May 20th press release when Mr. Lodders was made BLHG Chairman, that he had recently served as managing director of AGFA Hong Kong Ltd. Magistrate David Dufton decided against jailing Myers, 59, because of the lack of corruption element in the case, despite the fact that he was charged under the Prevention of Bribery Ordinance. Myers pleaded guilty on Saturday to a charge of accepting an advantage as a civil servant. ``Had there been a slightest whiff of corruption . . . a prison sentence would have been appropriate,' Mr Dufton said in his ruling. Myers had failed to repay $33,999.80 - the value of 47 reams of Sunray paper - to Agfa-Gevaert, a sponsor of his book on an English watercolour artist. ``The act of the defendant in not seeking retrospective approval is really an act of gross stupidity and neglect, seemingly driven by his life-long ambition to publish the book on William Henry Pyne,' Mr Dufton said. Myers had worked on the manuscript for more than 20 years. In February 1995, he and Hans Lodders , managing director of Agfa, discussed publishing the book. ``The defendant had very much brought this prosecution upon himself for the Civil Service Branch did not refer the matter to the ICAC, ' Mr Dufton said. ``For all one knows, had the defendant paid, he may not be in court today.' The defendant had sought retrospective approval to accept the sponsorship but was rejected by the Civil Service Branch. Mr Dufton said it was a serious offence because Myers had used his official position for his own benefit. His failure to pay due regard to the conflict of interest amounted to misconduct. ``The defendant is a very senior civil servant and only the highest standard is expected of him,' Mr Dufton said. ``It is indeed always a tragedy when a person with high reputation comes before the court with that reputation in ruins.' Myers and his family returned to England last night. His lawyer Edward Laskey said the former civil servant would seek to recover ``hundreds of thousands' of dollars in employment benefits, which is being withheld by the government pending the outcome of the case.
