JDN - as another attorney on the thread let me weigh in and say his comments weren't actionable. First of all fair value is a "subjective" opinion. MSFT has continually offered up the opinion at every conference call and analyst call a cautionary note about technology sales; valuations and the like. I seriously doubt that his comments "caused" the market to fall.

My thoughts are that we are at the end of the fiscal quarter; it is tax selling time for mutual funds and there is levels of uncertainty over the dollar and the Y2K situation. This all in combination created the late day sell off. If this is so then there will be a recovery and this presents a buying opportunity. I really doubt anyone would ever be successful suing a technology executive over comments like Baumer's
