Clark,
"My opinion is that for GSM it is very unlikely that infringement with 089 will be found, and for NA-TDMA the chances are considerably better, but still not great. "

You might be right but my question is then why have all the Japanese licensed with IDC for GSM ? It's hard for me to grasp that so many Asian legal departments have reviewed the patents and licensed the technology if they didn't have to.

Is that a fair question ?

The news releases by IDC as well as the SEC 8k filings have afforded GSM licensing.

I'm not qualified to determine or even afford an opinion on the validity issues . I'm not lazy either just not capable so I just form my opinions by accepting the fact that many legal qualified minds have already done the work for me.

The Asians have been easily convinced and seem to not like the courts. As we both know the Q as well as IDC both have had issues with ERICY and Mot. I do believe that's why Nokia is cleaning their clocks and will continue to do so. Nokia has licensed with Q as well as IDC so they too avoid the courts.

I do hope the final outcome in IDC versus Nokia is as successful as the Q's . If so the pancake chart of IDC will change.

I'm sure as this thing gets closer to going to court that many of the Q posters will jump in and get their feet wet if for no there reason because their used to being the under dog.
