Thank you for the article.

In the spirit of your post, the SEC would also have no jurisdiction if Ballmer publicly stated that RedHat is a better and more efficient operating system than Windows. He might say that in his private meetings, but let's say judgement was not a consideration here.

The SEC does not control all the ways a company can enhance shareholder value, just some of them. If a company wants to dig itself into the ground, it has every right to do that... legally.

I am not saying that Microsoft is doing this, but I am saying this to illustrate my point.
