JK, I watched the CNBC segment that you mention. The bigger pressure is not the pressure from the courts. If the court manadates open access, then what happens to their exclusive contract with Excite? I am not sure what happens to that contract.

ATT wants AOL and their 18 million eyeballs. The court order may help ATT to do that. But after the ruling, I am not sure if they could command the same value for Excite than they can do now. So why not make some money along the way?

I think they are not afraid of a court decision requiring them to open up broadband to ISPs.
