Let's put this "S-3" matter to rest.

Terr, I believe you are a nice person, so I won't react to the "lying" and "falsification" language you used in describing what I said in my original post.

Here is the truth: the paragraph posted by Max90 appeared first (to the best of my knowledge) in eBay's SEC report of May 14,1999 -- nearly five months ago. The same paragraph appeared in eBay's August report. I will take your word that it appears yet again in the recent S-3.

The post by Max90 began with, "eBay just filed an S-3," followed by "also this little scary bits from many." Then came the now-infamous stock paragraph.

If anyone else still cares enough to be reading this, I will let them judge for themselves whether Max90's post was intended to create the impression that this was a new and timely disclosure by eBay. If you, or they, think not, than so be it.

Of course it is possible that Max90 did not know the origins of the paragraph. Only he knows that, and he won't be telling me, inasmuch as he has vowed never to speak to me again.

Terr, J.C., Max, etc. I don't know *any of you* from a hole in the wall, but I have read all the posts recently trying to get more informed about this stock (including all the "shorts are evil", "longs are stupid" ones!)

What I read was that J.C. accused Max of "a dangerous and unethical step..." in addition to "Without attribution or date, you have excerpted out of context a single paragraph from eBay's S-10 filing of August 9, 1999". If it matters to anyone, this is not in my book "lying and falsification", but instead an accusation of being misleading - which is further amplified by viewing J.C.'s latest post - I can understand why the person (JC) said what he did, and understood where he was coming from before now.

What I will never understand here or elsewhere is why the shorts and the longs take such satisfaction in putting a pie in the face of the other, or using scare tactics. If any one of you is truly pleased that you have "won" and someone else has "lost" (and you are somehow superior) I feel sorry for you.

If I had an angle on this stock my approach would be to attempt to create earnest discussion of my viewpoint vs others, not perpetuate rock throwing.
