If Oxford meets or beats earnings the Class Action scare wont matter for the short run. On the note of Class Actions , I think its more of a scare Tactic to make HMO's "behave".
Also I doubt Congress will pass legislation that allows consumers to file suits against HMO's unless there is gross negligence on the HMO's part. The Insurance lobby is very strong , if you open the Law Suit flood gates , then Health Insurance premiums will sky rocket and the consumer and small business will end up footing the bill . It is a very complicated situation.
I just read in the paper this morning that most HMO'S will be raising premiums averaging %10 next year.
