I don't know if it has never been tried in court.

It would explain his actions and advice.

In this business, it is very common to try to have your customer lose money to you and then charge them a commission for the transaction.

I think that the laws that require due diligence and lack of conflict of interest apply to these folks. I also believe that proving it would require a run all the way to the Supreme Court.

We are being charged professional fees to be represented in a trade situation. As such we should be able to expect that they work for our best interests.

If they are the opposing party in a contract, then it is unreasonable to be required to pay them a fee for services rendered pertaining to that contract.
