Nothing wrong with maintaining that public opinion decides rights, it does. Thank goodness that rights aren't usually put to a popular vote, but they are determined by the opinions of such semi-elites as judges and legislators. Which is why it is so very important for intellectuals to speak freely, and well, in favor of rights, in order to persuade those who actually decide what rights are recognized and enforced.
