You are correct...

... and that is the purview, the duty and responsibility, of the human beings in the government. It is really the most important reason the government exists. If it failed to fulfill that function (as it has begun to fail during the last 80 years) then the government does not have an objective mandate to exist.

The problem with your assertion is that the protection of your rights takes the effort of other human beings.
