You're right, I meant Augustine. It was a slip of the fingers, of course. Augustus isn't nearly so interesting.

Korematsu, et al., I agree, were disgraceful. That's why Rehnquist's latest is interesting, but I haven't finished it.

As for not believing in balancing tests, well, of course you don't. But that won't make them go away. That's why the judicial system needs intellectuals, to persuade the judges to do the right thing. BTW, congrats on your achievements in Hawaii. I am sure you are a fearsome opponent.
