The killer factors are: 1. They've got temporary and part-time workers that can be assigned to work any day, and they give some of THEM Sundays off, but not her, and she's a permanent, full-time employee; 2. She's unassigned to any schedule, so can be moved at will; 3. Sunday is the lightest day, she could work on a busier day, but they put temps and part-time workers on those days. Over the years, she would either be given the schedule change or not, depending, solely, on who was the plant manager on her shift. One guy did it for months, the next guy refused to. In fact, about a year after I filed suit, a couple of weeks after her deposition by a U.S. attorney, they gave her the requested change and quit dicking around with her. So she's got what she wanted, but she wants to be compensated for all the Sundays she took off without pay, and damages for the gastritis she got from the stress, she's got permanent gastric reflux disease. They offered to settle a couple of years ago, but she was unreasonable. Now I am waiting for their promised Motion for Summary Judgment, and if we get past that, I'll try to settle again.
