learnstocks - I don't know that from a legal point of view a suit is plausible. I would expect that anything management did, they did within the letter of the law. OTOH, I am not a lawyer, and I'm not privy to all the technicalities, so I can't express myself on this.

As to damage done to the confidence of traders and investors in NITE - I can't speak for others, but I would never even consider becoming an investor in NITE... based entirely on my absolute and complete distrust of management. I don't care what the stock does, or how high it goes - I will not invest in a company that has as little regard for the individual investor. As a trader, I will continue to trade it - certainly, for the last few months, you couldn't lose shorting NITE.

From many PMs, talking to people, and reading boards, I am persuaded that my position is not unique - NITE management has earned a well deserved black mark among many individual investors. This has got to be damaging, at least in a segment of the investment community. I also suspect that many institutional analysts will be less anxious to come out with glowing ratings, having been badly burned by very poor earnings visibility and/or guidance from NITE.
