Is it totally off the wall to speculate that future HMO policy may be impacted by the recent State Farm auto parts decision? State Farm was held liable for $456 million in damages plus penalties, bringing the total award to $1.2B.

The judge and jury ruled that State Farm was negligent in requiring gray market, rather than OEM parts. The prevailing legal theory was that State Farm knew that gray market (generics) were not as good. When an ICE is only marginally better, might an HMO be negligent not to permit its use?
