Question does not seem to be whether FCC's staff (at least) is out to punish and perhaps destroy NextWave and annoint Nextel or some other company to take over at a new auction (or even without an any competitive bidding at all), but whether the appeals court will permit that.

But again, this is just how this complex situtation looks from the outside, and I for one certainly don't even pretend to know the ins and outs and the legalities here. Just seems strange on its face.
