I disagree that patents are invalidated often. At times, during a re-exam, the claims maybe narrowed, but re-exams usually do not invalidate a patent.

Well, u are arguing two points. Yes, Priceline.com will have to prove that Microsoft is infringing on their patent. During infringement, the application history will be looked at and that is called file wrapper estoppel.

Microsoft, will have to prove that Priceline's system is either non-obvious, or file a piece of "Prior-Art" which documents Pricelines system.

I disagree with your comment that Microsoft would have settled. Microsoft rarely settles, didn't they take Stacker to court over patent rights when Stacker alledged that MIcrosoft infringed? A Patent Infringement suit can be extremely costly to both sides. Judgements can be in the 100s of Millions or even Billions....
