The more I read about this, the worse I feel. Especially the following: The OSC chose to prosecute the Cowpland case in the Ontario Court of Justice, rather than pursue an administrative proceeding under the securities commission's own regulatory authority, which would carry lighter penalties but require a lower standard of proof for OSC staff. About three-quarters of all cases the OSC pursues go through the securities commission's own administrative disciplinary process and many of them end up with negotiated settlements. Such behind-the-scenes maneuvering won't occur in this case.
