Before you are trying to make a fraud case out of this situation, you'd better read THIS article very carefully. You may find a statement in there that says: It COULD affect 3rd qtr results. It's never a good idea to call people liars when you don't read up on the facts. cbs.marketwatch.com

LT: That law degree of yours must be MIGHTY dusty. How do you think you could file a 10b-5 action against Dell. In the first place according to what you've posted here (which we all take with several boxcars of salt)it would appear you have no standing to sue, since you shorted Dell you are not a shareholder. Even if you could somehow claim some status as a shareholder based on your short sale (just for argument's sake)you would have no damages (except perhaps brain damage, but that was undoubtedly a pre-existing condition), since the announcement will clearly make you money on your short, (that is if you are not foolish enough to actually wait to cover @ $5, which you also posted here). So I'm curious as to how you would make this claim. I suppose you could file on behalf of other shareholders, but who in their right mind would hire you to represent them!!<GGGGGG>. Cheers Alohal
