McGinn can make a comment whenever he wants. A 'quiet period,' when referred to in this context, is not imposed by the SEC, it is a company policy.

And, even if a company decides to have a quiet period as policy, if there is material information that develops at a company, that company has the obligation to disclose the information as soon as practicable, quiet period notwithstanding.
