Hard to tell. Venue is different than jurisdiction. Likely it would go to a Federal court - diversity jurisdiction. Venue is more a matter of convenience and could put it in New England or CA. Venue, unlike jurisdiction, can be waived.

Under what theory? Do you have any provable damages? If not, you'll have to hope for punitive. Were they egregious?
