Ed, I agree that the worst case has been priced into the stock. Nobody expects much from Jackson.
That is why i have been adding to my holdings and plan to continue until Friday and possibly make it my number 1 holding again (has not been since June). Looking at Intel and Home Depot as well as a way to play the addition to the dow. Since those fund managers are required to buy, there will be a huge demand for these shares.

Normally, when companies get added to the S and P 500, the buying could be stretched out for days or weeks--and the new additions don't have a big weighting.
In this case, we have a huge amount of buying as there are only 30 stocks in the average.
I realize that the S and P 500 based index funds are more popular.
However the addition of MSFT and INTEL will make the Dow more popular--which is turns pushes up the Dow stocks.

Now i would consider a Dow30 mutual fund. In the past i would have ignored it and i think lots of investors feel the same way.

ed: If the judge rules against MSFT in the findings of fact (I can't imagine that there are any material facts to find for the plaintiffs but this guy has great imagination when it comes to MSFT) then there will be a whole new round of even more dire speculation of how Draconian the remedies will be. I conclude this as what else could be holding this stock back but other than the fear engendered by the shadow of this suit. New and more cautious money will therefore avoid entry or reentry in a big way as they choose to err on the side of caution. As Craemer would say this is my wife's thinking and she is usually in tune with the masses and how they think.

Further there will be additional speculation as MSFT takes it through the appeals process. This will continue to be a drag on the stock and it will be held in check until the case is resolved in MSFT's favor or a mild remedy is put in place.The stock will no doubt continue to exhibit every excuse for moving upward with greater sales and and profits but this DOJ genie has to be stuffed back into the bottle. I hope that SUNW,AOL and the rest of the cabal that have loosed this plague have this very disease visted on them some day. JFD
