Seems like some PTO examiners just hand 'em out these days.
If the idea pans out commercially, it gets contested. That's the real examination.

Nichia's coverage may end up being limited to specific techniques such as Nakamura's method of doing the p-type doping. A tremendous amount of prior art is available to challenge more general claims. From a practical standpoint, once others know that it can be done, the same end can often be achieved by different means, and there's not much the original inventor can do about it. In this case it is p-type doping of GaN with low resistance, and it's now a known fact of nature that this is possible.
