Agreed, it is hard to predict when Judge Jackson will rule, particularly assuming, for the sake of argument, the ruling is being delayed because of ongoing settlement talks.

IMHO, a better position than Cramer's straddle position is to hedge by buying SUNW. If MSFT takes a hit, SUNW will run; but if MSFT does not take a hit, I see little downside to SUNW, which is truly on fire.
