re: The Lexar Media Patent Infringement Docket

On September 17, 1999 three things happened, all in favor of SanDisk (plaintiff). First, the court denied motions by Lexar Media to strike DECLARATIONS by Mr. Ladra and Mr. Auclair made on behalf of SanDisk regarding the motion for partial summary judgement of contributory infringement. Second, the court set a hearing date for SanDisk's motion for partial summary judgement of contributory infringement for January of 2000. Third, SanDisk made a motion for preliminary injunction with counsel (presumably SanDisk and Lexar counsel) to agree on the form of injunction.

The docket reads as follows...

9/17/99 MINUTES: (Hearing Date 9/17/99) denying defendant's motion to strike declarations of Michael Ladra and Daniel Auclair, setting hearing on plaintiff's motion for Partial Summary Judgement of contributory infringement 10:00 on 01/21/00; plaintiff's motion for preliminary injunction - counsel to agree to a form of injunction; submit to court by 09/21/99.

Three days later Lexar made notice of a filing of bond.

9/20/99 NOTICE by defendant Lexar Media Inc. of filing of bond pursuant to FRCP 65(c).

9/20/99 PROOF OF SERVICE by defendant Lexar Media Inc. of (the above) notice.

I still wish to know if anybody knows of the statute "FRCP 65(c)" and what importance it has with regard to the preliminary injunction requested by SanDisk.
