I think you have to assume that neither set of lawyers are dummies, so they both put on evidence addressing every major point. It then boils down to a question of credibility. From what I saw of Mr. Gates' testimony and demeanor, and from what I heard about them not being able to respond to some points because Microsoft (a software company, no?) supposedly does its accounting by hand, I'd say their credibility isn't high. Of course, I didn't sit through all the testimony -- perhaps you did? An appeals court isn't going to run roughshod over a trial judge on matters of credibility. And I'm not aware of any constitutional issue or pressing matter of law being involved, so I doubt the Supreme Court would even take the case. But that's JMHO, and neither investment nor legal advice or opinion.
