The point of this exchange is not patent infringement but the fact a company with a strong position will not be brow-beat into settling if they know they're right.

Pat, somewhat naive view. Companies with weak financial postioning, are "brow-beat" every day. I'm not saying NN falls into this category with LU, but this assertion just isn't accurate.

You're right that ECI is not at the forefront of DSL development. However, they're ready to ship products based on TI's DMT and they can't until the case is settled.

ECI has shipped ADSL product in Europe (and South America, I believe). The biggest contract to date is DT.

PETAH TIKVA, Israel, Sept. 9 /PRNewswire/ -- ECI Telecom Ltd. (Nasdaq: ECIL - news) announced today that it has been chosen by
Deutsche Telekom AG to supply its ADSL-based Hi-FOCuS solutions.

ECI Telecom's Hi-FOCuS systems will be deployed by Deutsche Telekom to deliver Broadband Internet, Video, and multimedia services to an
additional 84,000 subscribers throughout Germany in the year 2000. The new contract follows Deutsche Telekom's successful implementation of
its original ADSL program, initiated in September 1998, of which ECI Telecom was awarded a significant portion.

Hi-FOCuS, incorporating ECI Telecom's innovative FractalLink(TM) architecture, is designed to enable co-existence of different transmission
technologies (e.g. ADSL, ADSL lite, SDSL, and VDSL) within a single platform. This ability broadens the variety of services that can be
provided through the system. Its ATM to the Subscriber architecture enables it to differentiate service packages by supporting four Quality of
Service (QoS) classes.

The system additionally features ATM-OAM (Operation, Administration and Maintenance) capabilities, enabling Deutsche Telekom to remotely
detect and localize failures on the ATM service level.

I'm having a hard time understanding the "You don't go to trial if you're not sure of your position" rule.

LU sues NN (Goliath v. David): LU is being a brow-beating lawyer-driven opportunist; NN's decision to not settle is proof that NN is in the right and will prevail because YDGTTIYNSOYP.

ECI sues TXN (David v. Goliath): ECI is being a brow-beating lawyer-driven opportunist; TXN's decision to not settle is proof that TXN is in the right and will prevail because YDGTTIYNSOYP.

ALA v. ORCT (Goliath v. David): ALA is being a brow-beating lawyer-driven opportunist? ORCT's decision to not settle and let the matter be resolved in the courts is proof that ORCT is in the right and will prevail because YDGTTIYNSOYP?

A hypothetical:

TXN sues ORCT (Goliath v. David) over ADSL patents. ORCT elects to not settle and let the matter be resolved in the courts. Would this be proof of ORCT's being in the right and will prevail because YDGTTIYNSOYP? Is TXN being a brow-beating lawyer-driven opportunist?

Your comments over the years have always led me to believe you'd back TXN in such a suit but YDGTTIYNSOYP suggests you'd expect ORCT to prevail.
