Tech: A middling muddling settlement will do nothing other than muddy the waters. Anything short of a clearcut decision will put the DOJ in the software design business with the District court as the arbiter between the company and the DOJ. Everyone time MSFT would seek to innovate they would have to ask the DOJ's permission and then wait see if the DOJ and the judge thought it was appropriate. This is a slippery slope for all and if I were AOL I would be thinking twice about such governmental oversight. You are looking through the short sighted end of the telescope or perhaps I should say Kaleidescope as this whole situation is a mess that the Judge, DOJ and MSFT haters have brewed up and now threatens to poison all.
