well, I can't say how serious they are but it is not stopping them from offering internet cable. The issue with open access that most people seem to not understand is it is NOT BROADBAND INTERNET ISSUE!! it deal with bundling products. T won't upgrade Portland facility to offer bundling local/long distance/internet but they are not stupid to ignore the 40 bucks they can get monthly from internet subscribers. They love to get another 40 for phone service but the open access issue is not slowing them down one second. Blame the slow penetration on TCI. Since T took over, they are spending and upgrading.

I am quite surprised to hear that AT&T is offering high-speed internet service (must be @home) in Portland. It says to me that they either are extremely confident they can win the legal battle or don't really care if they win or not.

Even if the courts allow "open access" the issue will continue to be tied up with the courts and the regulators until @home exclusivity expires anyway.

Bottom line is that "open access" is not technically reasonable right now. Even if forced to attempt it (as in Canada), it cant be done until the engineers & politicians work through many complex layers of details.

In the end any community that has insisted on "open" access will have fewer services and worse quality. Such is the nature of regulation.
