Concerning Optimark

This potentially positive agreement for NITE
seems to vicariously gives a needed leg up to
Optimark as they are not a registered broker-dealer.
Optimark is a non regulated entity.
It is not subject to inspection and examination by the SEC;
it is not required to have regulatory capital and to meet other basic standards of broker-dealer regulation;
it is not required to comply with the safeguards of Regulation ATS and
is not subject to any independent oversight.
Therefore if OptiMark were to fail to fulfill its responsibilities, there are no regulatory ramifications.

This non-mutually exclusive agreement with NITE is a positive step in the right direction. It telegraphs some of the moving and shaking which is going on in the Industry. This agreement seems to be a witness to the beginning changes which have been long overdue. It tends to validate the demand and move towards such Alternative Trading Systems. There still (as you have clearly stated) remain many question concerning the fleshing out of this agreement between both parties.
