How about shorting ESTM after it's quiet period run. It seem like it has a weak business model and their commericals are a joke.

Just heard on the conference call (Exide NYSE: EX)denied any criminal investigations. Guess they do not consider the Attorney general state of Alabama as an investigator and prosecutor of fraud cases.

4. Exide Manufatures and sells automobile and other type of batteries throughout Alabama and the United States. These sales are completed through local auto parts stores and other retail stores such as K-Mart, ect. Exide also manufactures and sells or has sold batteries to certain entities which bear the label of the purchasing business which then, in turn markets the product at retail under its corporate name I.E. Sears

5. Beginning in or near 1993 and continuing to the present, Exide has manufactured and sold its products to East Alabama and other retailers in Alabama. These batteries were represented and sold as " new or first quality" . However, the bateries sold by Exide to East Alabama and unwittingly resold as new batteries to Alabama consumers, includingthe state of Alabama itself, were actually used or refurbished items which had been cleaned, recharged and relabled as original manufactured products. Also it is alleged that Exide knowingly and intentionly mislabled batteries to inaccuratly reflect their cranking amperes, misrepresented the effect warranty period of the batteries and otherwise incorectly labeled batteries as to their characteristics and proper use.
