I think he's right to ignore that. A MSFT win would likely have wording like "the court feels there is insufficient evidence of consumer harm". That's tough to appeal because generally new evidence is not admitted at that stage.

Presumably, if the DOJ is allowed to add evidence, MSFT would get a chance to point out that ASKJ is up 733% in the last 3 months and AOL has doubled in the last month. And this is indicative of "diminishing investment"...unhuh.
