by Brent Mudry
Long-time Gala-Bari International director Dianna Hubert of North Vancouver
faces a share loan suit from businessman Dale Barlage. In a statement of
claim filed Dec. 16 in the Supreme Court of British Columbia, Mr. Barlage
names Ms. Hubert and Gala-Bari Il Grande Magazzino, which he asserts
operates a cosmetics business. Gala-Bari International is not named as a
defendant. Mr. Barlage claims that he loaned 200,000 shares of Upland
Global, then worth about $120,000, in April of 1998 to Ms. Hubert, to be
used to secure short-term working capital for Gala-Bari.
The suit claims the defendants promised not to sell or transfer the Upland
shares, to return the shares on demand, and to give Mr. Barlage 60,000
free-trading shares of Gala Bari for every $10,000 loaned. Mr. Barlage
claims the defendants have not returned the Upland shares, made any other
payment or transfered any free-trading Gala-Bari shares. No statements of
defence have yet been filed.
