It is deficient in not having been run through the rigorous test of a trial, but it is sufficient to base surmises on, which is what we do about most things. What interests me are those who want to argue that his silence is not evidentiary. Of course, there may be some other explanation for it, but it is likely that he cannot speak without exposing himself to further humiliation. He was almost certainly in the room, and had rough sex, he would merely dispute the consent issue. However, one no longer can claim misunderstanding if there is an overt request to stop, so he is on thin ice.....
