I think a settlement is much more likely now, with the DOJ and with Sun. Now that Microsoft sees how weak their hand is, they'll be willing to give what they wouldn't before. And the DOJ won't up their demands as they have to appear to represent the people's interest, and not to be on a crusade to destroy Microsoft.

One thing that's funny to me is the discussion of the "Baby Bills" remedy in the press. Where do they get the idea that there's any similarity between this case and the T settlement? If they broke MS into three companies selling the same product line, all they would have to do is let two of them die to get right back to where they are today (viz. Red Hat vs. Caldera et. al.).

Jackson is going to have to deal with the fact that the situation has changed so much since the start of the investigation that the main issue is becoming more and more moot. I personally think the best remedy is just to open an office staffed with a dozen federal bureaucrats in Redmond, and let them sign off on every contract M$ signs to make sure they're not doing anything illegal. Most of M$ crimes were committed with contracts and lawyers, not with technology or product definitions. I honestly think that would fix the problem. It's probably not a permissible remedy though.
