If the judge is making findings of FACT those are decisions and are entitled to a great deal of deference by any reviewing court- because the Judge is presumed to be closer to the original material and witnesses. Reviewing bodies look mostly at procedural issues- findings of fact are rarely reversed on appeal- not saying it doesn't happen, but findings of fact are given great deference.

There are two to three phases with this type of proceeding.

The first today after the trial is where the judge delivers the "Finding of facts"

A later phase is called the "Decision" if things get that far. And the decision can be appealed if MSFT chooses.
