I would agree with your point about the inappropriateness of an antitrust action to deal effectively with a fast changing technology. However, I would also point out that, if the evidence presented at trial can be believed, many companies were harmed by the anticompetitive behavior. I do not see any justice whatsoever in pursuing a claim to the Supreme Court - a process which takes time and costs a lot of money - the effect of which is to deny people who have been harmed their due compensation. That is unjust and does not comport either with the law or with decent business practice.
