"So if I understand correctly, your position is that it is simply random noise that led to the investigation of both M$FT and INTC but spared SUNW and many other companies? "

No, you do not understand correctly. SUNW, Netscape, and a number of other companies went after MSFT. That was obvious from the outset of this case. They feared MSFT dominance and had not been able to effectively compete against what was a natural desktop operating system monopoly. They feared that they would be confined to proprietary niche markets. Also, the DOJ had previously publicly embarassed itself with its fumbling accord with MSFT.

"That is, SUNW, which you assert (without, of course, offering any evidence to back the assertion) "certainly" engages in the same illegal practices of which M$FT has been found guilty, is just kind of lucky that the DOJ hasn't caught on yet?"

You got it wrong again. I asserted that SUNW management is not concerned about ethics in its business practices. I have known and known of many of them.

Now unethical practices are not the same as illegal practices. I did not assert that SUNW is engaged in the same "illegal practice" of which you assert that MSFT is guilty.

It would be hard for SUNW to be engaged in the same "illegal" practices when they do not have the same products, distribution or market position that MSFT enjoys.
After all SUNW is a niche player in the computer business.
It is simply worried that its niche is going to close on it.

I am sure that if the SUNW management was scrutinized that they will be found to have violated many laws. But they are not important enough for the Government to shoot at.

"Maybe they're going after the criminals in order of size? Or do you have yet another conspiracy theory?"

Wrong again! I have not posited any conspiracy theories.

Do you work for SUNW directly or indirectly?

:)
