Because it would not jive with the Big Gov. Dem. anti business conspiracy argument.

Ed.. and Which particular findings by the Judge led you to believe that the DOJ is against innovation?... The Judge indicated that the evidence showed that it was Microsoft which stifled innovation. Do you have some link to material we can review to get smarter about how that is not true, and how the DOJ is against freedom of innovation? Everything I've seen about the DOJ case appears to be aimed at letting innovation flourish without fear of being crushed by Microsoft.
Point us to some facts, so we can get educated and make up our mind, Ed..

Ed, Where does a squirrel keep his lunch? You are a nutcase too if you feel that MSFT is the champion of innovation. They are in fact judged enemies of innovation. There have been many software companies that innovated assorted utility and plug in programs only to have MSFT to steal the idea and place it free in the OS. Some died, some fought...and won(Stac electronics), but mostly a generation of innovation was killed by MSFT. MSFT was and is the classic 800 pound gorilla that goes wherever it wants to go.......NOT ANY MORE. This ruling was so broad and well documented that it will not be overuled. Can you imagine all those e-mails being seen by the appeal court judges and ignored? There comes a time when you must admit your hand was in the cookie jar, and still is, even as you say "What do you mean, my hand in what jar,(jar rolls off table, leaving cookies in hand, crumbs on mouth, and cookie breath)
MSFT needs to be contrite, confess, be penitent, pay what is needed to make it right, correct itself and move forward.
Persistent denial will not pass muster....too much evidence in plain sight to be ignored. MSFT has the money, does it have the ability to do the right thing? Gates in his recent speech shows that he has great unplumbed depths of denial in his heart, a psychotic level of denial...he feels innocent, matches in hand, barn on fire...caught dead to rights.
MSFT has a single exit path. Admit truth...pay the price...move on.
Any other path will actually cost more and gain less.
