Just read the Reliably Fatuous Jim Seymour's Street.com article on the M$FT FoF. His take is that the FoF is basically the judge's way of saying, "Settle or I'll kick your butt" to M$FT.

Predictions of whether M$FT will settle are all over the map--everybody's got an opinion. Mine continues to be that they won't because, fiduciary responsibility or no, the M$FT execs put their egos and "competitive spirit" above the good of shareholders. I give settlement before appeal a 20% probability.

However, half the predictors, possibly including myself, are going to be wrong. What if M$FT does in fact settle? On the day that happens, M$FT stock will explode to the up-side like an H-bomb, probably dwarfing whatever movement we finally see in SUNW today. The explosion will occur regardless of the details of the settlement. The T's & C's of a settlement that would not boost M$FT share price would have to be inconceivably bizarre and IMHO falls into the "can't happen" category.

Just a thought.
