True to a point.... but the findings of fact are part of the public record and by themselves make a case...hence the Justice department has done more than half the work for civil suits that have yet to be filed

Right now the major reason for MSFT to settle is to make it more difficult for private lawsuits. A verdict would be public record. Also note that another judge/jury might disagree on the fact finding.
At least in this manner, the current findings don't become public record and have to be determined by whatever jury is reviewing the facts presented in any private lawsuit.
That is what i have been reading over the weekend. That is what the experts are saying.
