Nice to know that the Appeals Court doesn't let personal vendeta get in the way of doing their duty.

I bet appeals court will try to "level the playing field".

Brian, There is no doubt it was a personal vendetta. Maybe Microsoft can dig up some emails between Jackson and the special master he was going to appoint (Lessig)--which did not happens due to Microsoft's non-acceptance of his orders. Remember MSFT appealed even a district court procedure. Of course that could tick Jackson off in a big way.
The appeals court judges are very intelligent. If they notice a very biased decision, they will go out of their way to find a reason to reverse Jackson. Jackson appears to be challenging them to find holes in fact finding and the of the upcoming ruling.

Of courst there may be vendetta building up against Jackson on their part for not respecting their reversal of his injunction on Windows95.

BTW--I think Jackson's fact finding would have been looked at favorably (by Appeals) if it had not been so one sided.
