I feel very proud that due diligence can work in such a positive way to settle peoples nerves and help in attacking a potential problem in a sensible and rational way (rather than a knee-jerk response). I hate to quote myself, but last night I stated...I did not see where Lexar actually states that SanDisk is infringing, but I suspect a statement like this is to follow shortly. Its (a counterclaim's) absence from today's news is curious. I am certain that the Lexar general counsel would leap at any opportunity to embellish such a report. I think that I concluded correctly last night that Lexar was some how "fluffing up" the Patent Office decision by trying to make it appear as if they had been victorious in the ongoing patent infringement suit. Similar to the prior legal posts they have offered (in particular, the one they wrote on the tail end of the Taiwan earthquake and released on a Sunday before the Monday market open) it appears that they are trying to profit from shock value rather than substance. They are milking the Patent Office decision. I felt very proud of this damn Thread when I read the reply below...Eli Harari, president and CEO of SanDisk, said, "Lexar is engaging in misleading public relations statements. The decision of the U.S. Patent Office is completely unrelated and irrelevant to the patent infringement lawsuit that SanDisk filed against Lexar in March, 1998, relating to SanDisk's U.S. patent 5,602,987. SanDisk continues to vigorously enforce its patent rights in federal court, in the Northern District of California. SanDisk remains confident that its patent rights will be validated in this case. The decision cited by Lexar in its press release was not a court decision. There has never been any litigation between SanDisk and Lexar regarding the Lexar `083 patent.
