Sanctions are demanded against plaintiffs who bring trivial suits all the time. The problem is that paupers and unfunded corporations are judgment proof. These are the sources of classic nuisance suits. You pay them off because it is cheaper than the legal costs of moving for summary judgment and demanding sanctions (which will not be paid). The problem is that requiring bond or the equivalent (full payment of attorneys' fees as in Japan) essentially bars the poor from court. I would like to see the offending attorneys flogged, one stroke per $100 sanction. This flogging should be in public, admission should be charged (PPView TV would be nice, or Videos -- "100 Goriest Lawyer Floggings!") with the proceeds going to the victims.
