I can't answer why there was a "tweak" as you mentioned because
I don't have the details of the decision process from that time.

Since I left the company, I've been watching this certification
process at Cablelabs shift in what it considers testing from
round to round. I'm pretty frustrated with the process myself
and wish I could see how the other earlier certified vendors
were treated. Seems to me if they are going to sell their wares
to the public, the test results ought to be public too. In answer
to your second question, I agree with your logic. I just don't
feel that the "passing" part follows an objective yes/no process
at Cablelabs based on what was said in that one CC.
