hi,
i want to inform you about the service provided by the northpoint's isp partner TERABIT of new york. i'll describe
the situation first and ask some questions at the end of the e-mail.

the connection:
416kb sdsl connection via northpoint (business grade). the isp providing internet connectivity is terabit.net.
connectivity:
my connection was working over several month at 416kb upload and download speed. i was very happy with the
speed and reliability of the service.

what changed:
the up- and downloads to terabit's server still work as usual - 416kb, no problem. but the world behind terabit is
since about a week barely reachable. internet downloads from reliable ftp sites take hours instead of minutes if
they don't time out entirely. it takes my clients a long time to download my work from my homebased ftp if they
succeed at all. video conferencing equipment i bought to be used with my dsl line doesn't perform anymore as it
did with the connectivity i got until last week.
the bandwidth situation gets better at night and in the very early morning - not much help for my particular
situation.

a real world example:
i use to listen to a live streaming broadcast over the internet. the mp3 audio stream is targeted towards an
audience equipped with 56k modems. i was using two similarly equipped computers to test the connectivity. i
connected box 1 with a FREE dialup account to the mp3 server and did the same with the dsl connected
computer 2. i had continuos sound from computer 1 with the 56k modem while computer 2 with the dsl modem
disrupted the broadcast repeatedly and dropped the connection all together.

technical issues:
the connection to servers at terabit works as reliable and speedy as usual. there is nothing to trouble shoot on
this end.

what terabit thinks about this according to several phone conversations i had with them over the last few days:

-i should be grateful to have received all the free bandwidth i didn't pay for in the past
-terabit guarantees 1% (one percent) of the 416kb line it sells which results in 40kb
-everybody who receives above the mentioned one percent doesn't have the right to complain
-users who don't transfer files at the full speed should complain to their fellow users who use the same pool of
bandwidth
-it is totally legal to provide just one percent of the connection speed. it didn't have to be mentioned on the
web site or in the contract. (which it is not)
-the dsl line and computer connectivity are two different issues. terabit pays for my 416kb dsl line a fee to
northpoint. the internet connectivity terabit provides is a different matter and has nothing to do with 416kb of
the dsl line.

why i choose to go with a northpoint dsl solution:

-good price/bandwidth ratio
-high reliability of the "business grade" solution
-416kb instead of my 56k modem
-static ip address for my telecomuting (ftp, video conferencing, bbs)
-i could provide reliable up/download speeds to my employers
-no bandwidth sharing as with cable modems

i am very happy with the service northpoint provides. it was a big improvement to be able to telecomute while
being close to my family.

could you recommend an isp who is willing to guarantee more the 40kb/sec transfer speed? the emphasis is on
reliable speed, not speed bursts.

could you point me towards literature describing the legality of the magic "1% issue" referred to by your isp par.
