>> Since this OEM has accepted the product, and in fact is paying the costs of retooling

Rich, I'm not sure that we actually have that specific information -- it is perhaps the most reasonable interpretation -- but I think it's not exactly what was said in the PR or CC.

The customer's "commitment" is unspecified ... acceptance terms are not revealed. I think we know basically nothing about the OEM<->Moltech contract.

"Paying the tooling" ... the PO is from Moltech ... it's not specifically said in the PR who is eating the tooling cost. If Lev made any verbal attribution in the CC, it has to be taken with a grain of salt ... Lev may not actually know the gritty details of how the money works between Moltech and the OEM ... he may, he may not ... we simply don't know.

Valence Technology Receives Substantial Initial Order for Lithium Polymer Batteries

HENDERSON, Nev., Nov. 11 /PRNewswire/ -- Valence Technology Inc. (Nasdaq: VLNC) today announced that it has received a purchase order from Moltech Power Systems (formerly Energizer Power Systems) for the company's advanced technology lithium polymer batteries based on a commitment from a major satellite and cellular phone customer. This initial order, which represents approximately three months of customer requirements, is for over $2.0 million, including engineering setup charges. Further orders from Moltech will be based on performance and customer demand.

I'd like to see us all be rather more stringent in distinguishing the facts and their specific sources from our personal interpretations, however valid.

Not my intent to single you out ... just caught my eye and I thought I'd take a moment to put the request before the thread in general.
