Anyone can still bid as hi as they choose, If Barrick doesn't wish to match the best offer then they are out. To me this statement only gives Barrick a small advantage as they only have to match other bids to win, where others parties will have to continue to increase the bid. I think fair competition is still in full swing under this agreement.

Not at all. It doesn't preclude any offers from anyone; it just gives Barrick the right to match it or exceed it before Pangea accepts any offer from someone other than Barrick.
