I think that's an important point. Microsoft had plenty of opportunity (and the help of plenty of lawyers, Heaven knows) to present its case, including all the arguments we're now hearing from "Monday-Morning Jurists." The judge, sitting in the room with them and able to look them squarely in the eye, seems to have found the DOJ's presentation more credible.

If one is willing to at least concede that reasonable minds may differ on the relevant points, then who is in a better position to decide than was the judge? Certainly not a bunch of biased shareholders (or, for that matter, a bunch of competitors).
