The disdain for penumbras comes from Justice Blackmun's own language. Didn't he draw his conclusions from "penumbras that emanate from the Constitution"? To go along with him on this line of thinking we're saying that we can make it up as we go along. In that case we really have no Constitution.

I won't argue with your other points, they are good ones. I guess the only question is, is the unborn child an individual?

We could form a scientific commission to study the issue of when human life becomes deserving of protection. Advancements in medical technology have made it possible to determine that. I don't think the womb is a "black box" as you previously indicated.

Your hypothetical about Massachusetts criminalizing witchcraft and burning guilty parties at the stake is a little over my head. I suppose if that were to happen we'd have a revolution up there.
