So the solution is to force them to give up their own, privately developed code to the world instead of having the market compete on the merits.

They broke the law with it, that's why you take it away from them.

Just like you take a gun away from a murderer and your kids favorite toy when they mis-behave.

That's called punishment (and common sense).
